This End-User License Agreement (the “Agreement”) is a legal agreement between you (the “User”) and CHANTAL PRO SIA, registration number 40103332030, Bebru iela 16–34, Jēkabpils, Jēkabpils nov., LV-5201, Latvia (“we”, “us”), governing your use of the Android application mcpro24fps in all of its editions (the “Application”). By installing or using the Application you agree to this Agreement. If you do not agree, do not install the Application, and uninstall any copy you already have.
1. Editions covered
This Agreement covers: the full version of mcpro24fps, purchased through Google Play, Huawei AppGallery, Samsung Galaxy Store or RuStore; the Demo version, which is free and cannot record video; and the Russian build, which we distribute directly as an APK file and which offers a reduced feature set. The desktop application mcpro24fps Meta is licensed separately under its own agreement.
2. Relationship with your store
Where you obtained the Application from a store, that store's terms also apply to the transaction itself — payment, receipts, refunds, family sharing, and re-download rights are governed by the store, not by us. Nothing in this Agreement limits the rights the store grants you, and where this Agreement and the store's terms conflict on a point about the transaction, the store's terms prevail.
3. Licence granted
We grant you a non-exclusive, non-transferable, revocable licence to install and use the Application on devices you own or control, for as long as you comply with this Agreement, under the terms of the store account through which you obtained it. The Application is licensed, not sold; we retain all rights not expressly granted.
4. Your footage is yours
Everything you record or produce with the Application — video, audio, RAW and DNG frames, snapshots, LUTs and presets — belongs to you. We claim no licence and no right of any kind over it, and we have no access to it: the Application transmits no media anywhere and communicates with no server of ours. You may use your footage for any purpose, commercial work included, with no additional licence and no royalty.
5. What you may not do
You may not:
- modify, adapt, translate, reverse engineer, decompile, disassemble or create derivative works of the Application, except to the extent such restriction is void under mandatory law;
- circumvent, disable or tamper with any licence check, edition limit or protection mechanism, or use a copy in which someone else has done so;
- redistribute, publish, sell, rent, lease, sublicense or lend the Application, or make it available as part of a service to third parties; the Russian build may be passed on only unchanged, complete, and without payment;
- repackage, re-sign or bundle the Application with any other software or installer;
- remove or alter any copyright, trademark or attribution notice;
- use the Application in breach of applicable law, including laws on recording people, on privacy, and on filming in restricted places.
6. Intellectual property
The Application, its source code, its user interface, its name and its logo are the property of CHANTAL PRO SIA and are protected by copyright and other laws. Open-source components distributed with the Application remain under their own licences; those licences prevail over this Agreement for those components, and are listed in our Third-Party Software Notices.
7. Devices, firmware, and why the Demo exists
The Application drives your device's camera through the manufacturer's Android camera stack. Which frame rates, bit depths, codecs, RAW modes and vendor features are actually available is decided by your device's hardware and by its current firmware, not by us, and a manufacturer's firmware update can change or remove a capability at any time without notice.
For that reason we publish a free Demo version, and we ask you to install it and check your own device before you buy. We do not warrant that any specific capability will be available on any specific device or firmware version, and a capability that your device does not provide is not a defect in the Application.
8. Editions, features and updates
We may change, add or remove features, and may change what the Russian build and the Demo edition include, in later versions. We may provide updates through your store; updates are covered by this Agreement unless they come with their own terms. We are not obliged to support indefinitely any Android version, device or edition, and support is provided at our discretion.
9. No warranty
The Application is provided “as is” and “as available”, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
10. Recording risk — please read this one
A recording can fail for reasons outside the Application's control: thermal throttling, a manufacturer's camera or encoder firmware defect, storage that cannot sustain the selected bitrate, a full or slow memory card, the operating system stopping the app, or a battery running out. Such a failure may make the affected recording incomplete or unreadable.
Do not use the Application as the only record of an event you cannot repeat. For irreplaceable material, record a parallel backup on other equipment. To the extent permitted by law, we are not liable for lost, incomplete or corrupted footage, or for any consequence of such a loss.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, lost profits, lost work or lost data arising out of or connected with the Application. Where liability cannot be excluded, it is limited to the amount you paid for the Application in the twelve months before the event. Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot lawfully be excluded.
12. Consumers
If you are a consumer in the European Union, your statutory rights are unaffected by this Agreement, including the rules on conformity of digital content and your right to bring proceedings in the courts of your place of residence. Purchases and refunds go through the store you bought from.
13. Term and termination
This Agreement applies from installation until terminated. You may terminate it at any time by uninstalling the Application and deleting all copies. We may terminate it if you materially breach it, in particular clause 5. Termination does not affect your rights in the footage you have already produced, and does not by itself entitle you to a refund, which remains a matter for your store.
14. Governing law and disputes
This Agreement is governed by the law of the Republic of Latvia, excluding its conflict-of-law rules; for consumers, the mandatory law of your country of residence continues to apply. Disputes fall to the competent courts of the Republic of Latvia, without prejudice to a consumer's right to sue or be sued where they live.
15. Entire agreement and contact
This Agreement, together with the Privacy Policy for the Android app mcpro24fps and the Third-Party Software Notices, is the entire agreement between you and us about the Application, and replaces any earlier understanding about it. If a provision is unenforceable, the rest stays in force.
